ANTI SPAM POLICY

Tangible Influence is a dedicated email marketing service. Spamming is not only a serious offense, but we find it seriously offensive. Any client who engages in the act of spamming will have their account immediately terminated. The client will not be issued a refund, and will no longer be able to access any data in their terminated account.

In the interest of maintaining our white-hat status we have implemented both pre-screening and post-monitoring systems to catch violations before they happen. Some of our precautions include pre-screening clients, enforcement of guarantee opt-in contract signing, blacklist monitoring and news group reviewing, dedicated abuse team and ISP Feed-backs.

Spam Defined

Spam is unsolicited bulk email including “junk mail”. Unsolicited means the recipient has not verifiably granted deliberate, explicit and still-revocable permission for the email to be sent. Unsolicited email such as first contact enquiries, job enquiries and sales enquiries are considered to be normal email. Bulk means the recipient’s personal identification and context are irrelevant because the message is equally applicable to many other potential recipients. Bulk email such as subscriber newsletters, customer communications and discussion lists are considered to be normal email. To qualify as spam, the email must be both unsolicited and bulk.

Specific Prohibitions

The practices listed below are prohibited at Tangible Influence:

  • Email lists that are purchased, rented, leased, inherited or in any way obtainedfrom a third party are prohibited.Also, opt-in email lists relating to a certain subject matter maynot be used for an unrelated topic.
  • Batching or in any way trying to manipulate the addition of new subscribers to theweb from subscription methods is prohibited.
  • Posting to newsgroups or discussion forums that prohibit posts which link to offtopic newsgroups is prohibited.
  • Using false headers or other false information to identify the point of originor the transmission path of the email, or to hide the true origin of theemail sender is prohibited.
  • Unauthorized use of a third party’s internet domain name without the permission of suchthird party, to make it appear that the third party was the point oforigin of the email is prohibited.
  • Use of any false or misleading information in the subject line of the email isprohibited.
  • Assisting any person in using the services of Tangible Influence for any of theabove activities is prohibited.

Further Policies

  • All remove requests made outside the scope of Tangible Influence’s opt-out links must be finalized within the users account within 3 days of therequest date.
  • List owners using third-party companies to send, tack or host materials within Tangible Influence’s mailing services are also required to observe ourAnti-spam and Privacy Policies.
  • Clients must provide detailed opt-in information within 24 hours of request to avoid termination and/or additional fines.
  • All clients are responsible for their actions within the Tangible Influence system and will be held accountable for any broken laws including but notlimited to copyright infringement, using stolen data or harvested data,sending explicit material and/or emails to minors under the age of 13 unless child’s legal guardian has granted permission.

Spam Check

The following list contains red flags for spamming. If you are doing any of these activities you are most likely engaging in spamming.

  • Mailing to non-specific addresses, such as info@domain.com
  • Deliberately falsifying your originating address or transmission path information
  • Sending email to mailing or distribution lists which then send indirectly to other email addresses
  • Using a purchased list of any type
  • Mailing to someone who has asked to be deleted from your mailing list
  • Not providing a fully functioning unsubscribe link
  • Subject lines that include false or misleading information
  • Using a third party’s email address or domain name without thatparty’s consent
